Terms of Service

Welcome to LooksCraft. These Terms of Service ("Terms") govern your access to and use of LooksCraft's websites, software, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, accessing, or using LooksCraft, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may update these Terms from time to time. Material changes will be notified via email or through our Services. Your continued use after such changes constitutes acceptance of the updated Terms.

2. Description of Services

LooksCraft provides AI-powered tools for creating and editing videos and images, including but not limited to:

  • Image Craft: AI-powered image editing, enhancement, and variation generation
  • Video Craft Lite: Quick video generation with simplified controls
  • Craft Lip Sync: Generate professional lipsync videos with custom voice, actions, and advanced settings
  • Vision Craft: Premium video generation using advanced AI models (e.g., Sora 2) with reference images
  • Skin Craft: AI-powered skin enhancement and texture smoothing
  • Actor Generator: Creation of realistic AI avatars and actors

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. Account Registration and Requirements

To use certain features of LooksCraft, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach
  • Be at least 13 years old (or the minimum age in your jurisdiction)

You may not share your account credentials with others or allow others to access your account. You are responsible for maintaining the confidentiality of your account information.

4. Credit System and Payments

LooksCraft operates on a credit-based system. Credits are required to use various features of the platform.

a. Credit Purchases

  • Credits can be purchased through our payment processors (e.g., Stripe, PayPal)
  • All purchases are final and non-refundable unless required by law or as specified in our refund policy
  • Credit costs vary by feature and may depend on parameters such as video duration, resolution, or complexity
  • Credits do not expire unless your account is inactive for an extended period (as defined in our policies)

b. Pricing and Billing

  • All prices are displayed in your local currency and are subject to change without prior notice
  • You are responsible for any applicable taxes, fees, or charges
  • Payment must be made using valid payment methods accepted by our payment processors
  • Failed payments may result in suspension of Services until payment is resolved

c. Refunds

5. User Content and Intellectual Property

a. Your Content

You retain ownership of content you upload or create using our Services ("User Content"). By using LooksCraft, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and display your User Content as necessary to provide the Services
  • Use your User Content to improve our AI models and Services (unless you opt out)
  • Display your User Content in your account and as you choose to share it

b. AI-Generated Content

Content generated by our AI tools is created based on your inputs and prompts. You own the output generated for you, subject to these Terms. However:

  • AI-generated content may not be eligible for copyright protection in some jurisdictions
  • You may not claim that AI-generated content is entirely original or created without AI assistance
  • You are responsible for ensuring AI-generated content complies with applicable laws and regulations

c. Prohibited Content

You may not upload, create, or generate content that:

  • Violates any applicable laws, regulations, or third-party rights
  • Contains illegal, harmful, threatening, abusive, or discriminatory material
  • Infringes on intellectual property rights, privacy rights, or publicity rights
  • Contains explicit sexual content, violence, or hate speech
  • Is designed to deceive, defraud, or harm others
  • Violates our Acceptable Use Policy (see Section 6)

d. Our Intellectual Property

All aspects of the LooksCraft platform, including but not limited to software, designs, logos, trademarks, and AI models, are owned by LooksCraft or our licensors. You may not copy, modify, distribute, or create derivative works based on our Services without express written permission.

6. Acceptable Use Policy

You agree to use LooksCraft only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Services to create content that violates laws or regulations
  • Impersonate others or create misleading or deceptive content
  • Attempt to reverse engineer, decompile, or extract our AI models or algorithms
  • Use automated systems (bots, scrapers) to access the Services without permission
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services to generate content for illegal activities, fraud, or harassment
  • Create content that infringes on others' intellectual property, privacy, or publicity rights
  • Share account credentials or allow unauthorized access to your account
  • Resell or redistribute access to the Services without authorization

Violation of this Acceptable Use Policy may result in immediate termination of your account and legal action.

7. AI-Generated Content Disclaimers

You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, or unintended results
  • AI models may produce biased, offensive, or inappropriate content despite safeguards
  • You are responsible for reviewing, editing, and approving all AI-generated content before use
  • LooksCraft does not guarantee the accuracy, quality, or suitability of AI-generated content
  • AI-generated content should not be used for critical decisions without human verification
  • You should clearly disclose when content is AI-generated, especially in commercial or public contexts

8. Service Availability and Modifications

We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation. The Services may be temporarily unavailable due to:

  • Maintenance, updates, or technical issues
  • Third-party service disruptions
  • Force majeure events
  • Security or legal requirements

We reserve the right to modify, suspend, or discontinue features or the entire Services at any time. We will provide reasonable notice when possible, but are not obligated to do so for all changes.

9. Termination

a. Termination by You

You may terminate your account at any time by contacting us or using account deletion features. Upon termination, your access to the Services will cease, and your User Content may be deleted in accordance with our data retention policies.

b. Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms or our Acceptable Use Policy
  • You engage in fraudulent, illegal, or harmful activities
  • You fail to pay required fees
  • Your account is inactive for an extended period
  • Required by law or legal process

Upon termination, you will lose access to your account and User Content. Unused credits are generally non-refundable unless required by law.

10. Disclaimers and Limitations of Liability

a. Service Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

b. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOOKSCRAFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

c. Third-Party Services

Our Services may integrate with or rely on third-party services (e.g., payment processors, cloud providers, AI model providers). We are not responsible for the availability, performance, or actions of third-party services.

11. Indemnification

You agree to indemnify, defend, and hold harmless LooksCraft, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Services
  • Your User Content or AI-generated content
  • Your violation of these Terms or applicable laws
  • Your infringement of third-party rights

12. Governing Law and Dispute Resolution

a. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

b. Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with [Arbitration Rules], except where prohibited by law. You waive your right to participate in class actions or class arbitrations.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

c. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

d. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

e. Export Control

You agree to comply with all applicable export control laws and regulations. You may not use the Services in violation of export restrictions.
